Terms of Service

Effective date: April 24, 2026

These Terms of Service (“Terms”) govern your access to and use of the website at realsun.infoand any related services, applications, smart contracts, or tooling operated by RealSun (collectively, the “Service”). By creating an account or using any part of the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old — or the age of legal majority in your jurisdiction, whichever is higher — and legally capable of entering into a binding contract. You must not be located in, or a citizen or resident of, any country subject to comprehensive sanctions, and you must not be on any restricted-party list. You are solely responsible for ensuring that your use of the Service complies with laws, regulations, and tax obligations that apply to you.

2. Accounts

You agree to provide accurate information, keep it up to date, and safeguard your login credentials. You are responsible for all activity under your account. Notify us immediately at support@realsun.info if you believe your account has been compromised. We may suspend or terminate accounts that violate these Terms or present risk to the Service or other users.

3. The Service

RealSun lets you purchase fractional, tokenized interests in solar power plants (“NFT fragments”), receive periodic dividends in the form of RSC or RSP, resell fragments on the marketplace, and transfer RSP between users. The Service is a software platform; RealSun is not a broker-dealer, investment adviser, bank, or money transmitter, and nothing in the Service constitutes investment, legal, tax, or financial advice.

4. RSP and RSC

  • RSP (RealSun Points) are an off-chain utility credit used within the Service. 1 RSP = USD $0.10. RSP has no cash value outside the Service, is non-refundable, and may be forfeited upon termination of your account for cause.
  • RSC (RealSun Coin)is an on-chain reward asset delivered to your linked wallet address. 1 RSC = USD $0.10 at the platform reference rate. On-chain transfers are final, non-reversible, and subject to the applicable blockchain’s rules, gas fees, and congestion.
  • Conversion rates, dividend amounts, and settlement periods may be updated by RealSun from time to time and will be reflected in the Service.

5. Purchases, Rewards, and Marketplace

When you purchase an NFT fragment, the price shown in USD is converted to RSP at the then-current rate and debited from your RSP balance. Dividend payouts are calculated per fragment and may be distributed monthly at RealSun’s discretion. Marketplace listings are between users; RealSun facilitates but is not a party to those transactions and may charge a marketplace and/or auction fee disclosed at the time of sale.

All sales, dividends, and transfers are final once executed, except where we identify a manifest error or where required by law. You acknowledge that the value of fragments and tokens may go down as well as up and that you may lose the amount you invest.

6. Wallets and Private Keys

RealSun is non-custodial with respect to wallet private keys. You are solely responsible for securing your wallet and seed phrase. If you lose access to your wallet, RealSun cannot recover your on-chain assets. Transactions broadcast to a blockchain are irreversible.

7. Acceptable Use

You agree not to:

  • violate any law, regulation, or third-party right;
  • use the Service to launder money, evade sanctions, finance terrorism, or commit fraud;
  • manipulate markets, wash-trade, engage in front-running, or misrepresent your identity;
  • circumvent access controls, rate limits, or security measures;
  • scrape, reverse-engineer, decompile, or disassemble any part of the Service except as permitted by law;
  • upload malware, interfere with Service availability, or introduce any destructive code.

8. Fees and Taxes

Fees (including marketplace fees, auction fees, or blockchain gas costs) will be displayed before you confirm a transaction. You are solely responsible for determining and paying any taxes that apply to your transactions, rewards, and holdings.

9. Intellectual Property

RealSun and its licensors own all rights, title, and interest in the Service, including software, trademarks, logos, and written content. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes. No other license is granted by implication, estoppel, or otherwise.

10. Third-Party Services

The Service relies on third-party infrastructure (including Supabase, Resend, blockchain networks, and RPC providers). We are not responsible for the availability, accuracy, or policies of third-party services, and your use of them may be subject to their own terms.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. REALSUN DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT WILL BE SECURE OR NOT LOST. NOTHING IN THE SERVICE CONSTITUTES INVESTMENT, LEGAL, OR TAX ADVICE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REALSUN AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) USD $100 OR (B) THE AMOUNTS YOU PAID TO REALSUN IN THE TWELVE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to defend, indemnify, and hold RealSun harmless from any claims, losses, liabilities, damages, or expenses (including reasonable legal fees) arising out of or related to your use of the Service, your breach of these Terms, your violation of any law, or your infringement of any third-party right.

14. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.

15. Changes to These Terms

We may modify these Terms from time to time. If we make material changes, we will notify you through the Service or by email. The “Effective date” above indicates when the latest version took effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

16. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Korea, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the courts located in Seoul, Republic of Korea, except where applicable consumer protection law grants you the right to bring proceedings in your place of residence.

17. Miscellaneous

These Terms, together with any policies referenced herein (including the Privacy Policy), constitute the entire agreement between you and RealSun regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our consent; we may assign them freely.
